In Bid Document “INSTRUCTIONS TO BIDDERS” the items 13. PREVAILING WAGES and 14. EMPLOYMENT PRACTICES

TO BE REPLACED WITH THE FOLLOWING: 13: COMPLIANCE WITH LAWS and 14: NOT IN USE IN THIS BID DOCUMENT

13. PREVAILING WAGES

In accordance with the Illinois Prevailing Wage Act (820 ILCS 130), as amended, not less than the prevailing rate of wages for similar work in the locality in which the project is located shall be paid to all laborers, mechanics, and other workers performing work under the contract. These prevailing wage rates (i.e., the prevailing wage rates for Lake County) shall apply to the contract and shall be considered during the preparation of bids. If the Illinois Department of Labor revises the prevailing wage rates for Lake County, the revised rates shall apply to the contract. Prevailing wage rates for Illinois counties can be found on the Illinois Department of Labor website (https://www.illinois.gov/idol/Laws-

Rules/CONMED/Pages/Rates.aspx).

14. EMPLOYMENT PRACTICES

All Illinois statutes pertaining to the selection of labor, including the latest “Equal Employment Opportunity Clause” required by the Illinois Human Rights Act (775 ILCS 5) and the rules and regulations of the Illinois Department of Human Rights (44 Ill. Adm. Code 750) shall apply to the contract and shall be considered during the preparation of bids.

13: COMPLIANCE WITH LAWS

Contractor shall give all notices, pay all fees, and take all other action that may be necessary to ensure that the Work is provided, performed, and completed in accordance with all required governmental permits, licenses or other approvals and authorizations that may be required in connection with providing, performing, and completing the Work, and with all applicable statutes, ordinances, rules, and regulations, including without limitation the Prevailing Wage Act, 820 ILCS 130/0.01 et seq. (if the Illinois Department of Labor revises the prevailing rate of hourly wages to be paid, the revised rate shall apply to this Contract); any other prevailing wage laws; the Fair Labor Standards Act; any statutes regarding qualification to do business; any statutes requiring preference to laborers of specified classes including, without limitation, the Employment of Illinois Workers on Public Works Act, 30 ILCS 570/0.01 et seq.; the Illinois Steel Products Procurement Act, 30 ILCS 565/1 et seq.; any statutes prohibiting discrimination because of, or requiring affirmative action based on, race, creed, color, national origin, age, sex, or other prohibited classification, including, without limitation, the Americans with Disabilities Act of 1990, 42 U.S.C. §§ 12101 et seq., the Illinois Human Rights Act, 775 ILCS 5/1-101 et seq., and the Public Works Discrimination Act, 775 ILCS 10/1 et seq.; and any statutes regarding safety or the performance of the Work, including the Illinois Underground Utility Facilities Damage Prevention Act, and the Occupational Safety and Health Act.  Contractor shall also comply with all conditions of any federal, state, or local grant received by Owner or Contractor with respect to this Contract or the Work.  Further, Contractor shall have a written sexual harassment policy in compliance with Section 2-105 of the Illinois Human Rights Act.”

Addendum Reference:

Please read the IDOL Press Release (hyperlink below) regarding the recent Employment of Illinois Workers on Public Works Act http://www.ilga.gov/legislation/ilcs/ilcs3.asp?ActID=549&ChapterID=7. Please acknowledge, in writing, that your respective organization(s) will comply the requirements set forth on SMC202008 – Strawberry Condos Drainage Improvements Project The requirements are that 90% of your workforce laborer’s are Illinois residents. The requirements set forth in this Act will be in full effect until notified, in writing, by the Lake County Stormwater Management Commission. An excerpt of IDOL, Employment of Illinois Workers on Public Works Act, 2020 is provided for you below.

(30 ILCS 570/3) (from Ch. 48, par. 2203)

    Sec. 3. Employment of Illinois laborers. Whenever there is a period of excessive unemployment in Illinois, if a person or entity is charged with the duty, either by law or contract, of (1) constructing or building any public works, as defined in this Act, or (2) the clean-up and on-site disposal of hazardous waste for the State of Illinois or any political subdivision of the State, and that clean-up or on-site disposal is funded or financed in whole or in part with State funds or funds administered by the State of Illinois, then that person or entity shall employ at least 90% Illinois laborers on such project. Any public works project financed in whole or in part by federal funds administered by the State of Illinois is covered under the provisions of this Act, to the extent permitted by any applicable federal law or regulation. Every public works contract let by any such person shall contain a provision requiring that such labor be used: Provided, that other laborers may be used when Illinois laborers as defined in this Act are not available, or are incapable of performing the particular type of work involved, if so certified by the contractor and approved by the contracting officer.

Q: Do you anticipate extending the bid due date?
A: NO

Q: What additional details are you willing to provide, if any, beyond what is stated in bid documents concerning how you will identify the winning bid?
A: No additional details. Bid opening will be 2pm August 28th. Contract Award recommendation will be September 3rd SMC Board meeting at 6PM. 

Q: Does the contractor need to provide it’s own DECI, or will that be furnished by LCSMC?
A: Lake County SMC will complete the DECI inspections for this project.

Q: The bid quantity for spruce trees is 33 EA.  The plan quantity is 3 EA.  Looking for clarification as that will significantly skew the bids.
A: The correct quantity is 3 EA. TUESDAY AUGUST 18, 2020  CONTRACT ADDENDUM #2 reflects the update. A revised standalone Basis of Bid Form labelled “Basis of Bid Form Updated 2020.08.18” is available in the Document section of the Bid Details reflecting the Quantity update.

Q: Will an alternate be allowed for currently specified PVC for the 27-inch pipe?
A: No alternates or substitutes allowed for Item 21- STORM SEWERS, CLASS B, TYPE 2, 27" (PVC SDR-35). The conflict of utilities requires the profile of PVC pipe.  

Q: Excess Soil Material -How much can fit on the north rim of the existing pond? Confirm that any soil material removed from the site will be paid for at the unit price on the bid form, if it doesn’t fit on the rim of the pond?
A: Bids shall assume that all material identified as part of the “Site Grading” pay item and pipe and structure installations, excluding pavement material, shall be placed in the pond as noted on the plans for construction of a near-shore safety shelf and pad for the noted riprap outlet protection.  If it is determined during construction that adequate depth/space is not present in the pond for all material, at the direction of the LCSMC/Engineer additional material shall be hauled off-site and paid for as described in Items as Ordered by Engineer, “Excavated Material Haul Off and Disposal”.
